Learn What Biden’s Pro-PLA Final Rule and New Policies Mean for ABC Contractors

On Dec. 22, the Biden administration published the Federal Acquisition Regulatory Council’s ABC-opposed final rule, Use of Project Labor Agreements for Federal Construction Projects, implementing President Joe Biden’s Executive Order 14063, which requires federal construction contracts of $35 million or more to be subjected to controversial project labor agreements.
Maury Baskin and Ben Brubeck will provide an overview of the inflationary and anti-competitive final rule and its related White House Office of Management and Budget memo and its impact on ABC federal contractors. The presenters will also discuss other efforts by the Biden administration to push PLAs on federally assisted construction projects procured by private and government stakeholders. The speakers will also address ABC’s legal tactics against the rule as well as strategies to fight individual PLAs on federal and federally assisted construction contracts.

Maury Baskin serves as ABC’s general counsel and is a shareholder in the Washington, D.C., office of Littler Mendelson P.C., where he co-chairs Littler’s Workplace Policy Institute. He is one of the chief legal advocates for the rights of employers on labor issues throughout the country. Baskin has represented ABC and its member firms at every level of court, up to and including the U.S. Supreme Court.
Ben Brubeck is ABC’s vice president of regulatory, labor and state affairs. In this role, he works with his team to shape policy on local, state and federal issues important to the construction industry, and represents ABC before lawmakers, the media, construction industry executives and stakeholders. His expertise across a portfolio of issues includes labor and employment, workforce development, infrastructure, federal contractor regulations, small businesses and public works procurement.
